The resolution of a significant legal challenge occurred on Thursday, thanks to a favorable ruling from the Illinois Supreme Court, potentially alleviating insurance-related struggles for pedestrians involved in vehicle accidents.
Chris Guiracocha, who was struck by a vehicle while cycling near Montrose and Kimball three years ago, saw progress in his legal case following this development.
“This ruling unequivocally benefits all Illinois residents,” emphasized attorney Larry Disparti, reflecting on the impact of the court’s decision.
After the incident, Guiracocha and his family promptly submitted a claim to Direct Auto Insurance. However, the insurance company initially rejected the claim, citing that he was not inside the vehicle specified in his family’s policy. The resulting injury left Guiracocha incapacitated for several months.
“In the moment, I didn’t feel anything. I thought I died or got knocked out. Then I woke up, and after the incident, I couldn’t move for like six months… my whole right side,” shared Guiracocha.
Believing the case was concluded, Disparti Law persisted, arguing that an insurance claim should not be denied solely because the individual was on a bicycle.
After months of legal back-and-forth, the Illinois Supreme Court ruled in favor of Disparti Law, providing reassurance to the state’s residents that insurance coverage would extend to injuries caused by hit-and-run or uninsured drivers.
“The opinion today assures the residents of this state that if they are injured by a hit-and-run or uninsured driver, their insurance will cover them,” asserted attorney Jonel Metaj of Disparti Law.
While the attorneys have not secured victory in Guiracocha’s entire case, the court’s decision has paved the way for further proceedings, offering hope to him and others facing similar situations.
The family expressed relief at the prospect of assistance with medical bills resulting from the incident.
“I was really happy about it, to be honest. I was at work when we got the call. Anything will help. Anything we get out of it,” stated Guiracocha.
Despite the progress made, a protracted legal process lies ahead as the lawyers work to establish Guiracocha’s entitlement to compensation for injuries sustained in the accident.
